General Terms of Service

The health of the consignee and our drivers is very important to us. Due to the Corona, ServiceLine - free point of use and the B2CLine variants Plus and Premium are therefore temporarily suspended.

General Terms of Service (ALB)

These ALB apply to the services of the CargoLine cooperation partners. They also apply if and to the extent that CargoLine Track & Co. KG itself provides services (hub transhipment and, in exceptional cases: forwarding, transport, storage or logistics services).

The latest version of the General German Forwarding Conditions (ADSp) apply and, if these do not apply to the provision of logistics services, the latest version of the Logistics GTC.

Section 23 of the ADSp limits the legal liability for damage to goods in accordance with Section 431 of the German Commercial Code (HGB) to an amount of 8.33 SDR / kg and, for multimodal transports including sea transport, generally to 2 SDR / kg. Accordingly, if the freight forwarder's liability exceeds US $ 1.25 million per claim, his liability for each claim is limited to a maximum of US $ 1.25 million or 2 special drawing rights for each kilogram, whichever is greater .

The liability of the freight forwarder in the event of damage to the goods in his care is limited to the maximum amount of liability stipulated by law for a transport contract for sea transport and for cross-border transports. The ADSp also provide for exclusions of liability for sea and inland waterway transport in section 25.

Other general terms and conditions of the contractual partner do not apply.

The products listed here were developed by CargoLine Track & Co. KG. For the performance framework, which results from the respective product, the following regulations must also be applied, which take precedence if they deviate from the ADSp and the logistics terms and conditions (status: November 2020).

I. Cross-product (European land transport; for SeaLine see end of the ALB)

1. General requirements

To provide the services offered, the following general requirements must be met:

  • Orderly traffic conditions
  • Suitable packaging that is suitable for use and safe for transport, including precise packaging label

2. General exclusions

  • Packages> 6 m in length
  • Collo weight> 2,000 kg; cross-border> 3,000 kg chargeable weight
  • Valuables (valuables, precious stones, jewelry, money, chip cards, documents, certificates, securities, real pearls, coins, value cards, works of art, antiques, real carpets and furs, paintings)
  • Living animals
  • Live plants (exception: as transport with NightLine NextDay )
  • Temperature- controlled goods (exception: ThermoLine ), frozen goods, perishable goods
  • Tobacco products, especially valuable and theft-prone consumer goods
  • Moving goods
  • Drugs and narcotics
  • Dangerous goods according to Annex 24 of the CargoLine forwarding manager manual such as classes 1, 2 (T, TF, TC, TO, TFC, TOC), 4.1 (D, DT, SR2), 5.2 (P2), 6.2, 7 and waste
  • Firearms and ammunition
  • Delivery on Sundays and public holidays. In the case of non-uniform public holidays across Europe or Germany, the public holiday regulation of the delivering CargoLine partner applies.

For product-specific exclusions, see the respective product.

A pallet exchange takes place exclusively for standardized Euro flat pallets or standardized Euro mesh boxes. The contracting CargoLine partner defines the countries with which a pallet exchange takes place. There is no general obligation to exchange.

3. Scope

NightLine premium products, OrderLine, ServiceLine, ThermoLine and B2CLine / B2CLine Plus / B2CLine Premium: territory of the Federal Republic of Germany. Abroad on request.

NightLineEurope Priority, Fix and Receipt: Belgium, Bulgaria, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Netherlands, Norway, Austria, Poland, Portugal, Romania, Sweden, Switzerland, Slovakia , Slovenia, Spain, Czech Republic, Hungary, United Kingdom. Other countries on request.

The scope of NightLineEurope NextDay is determined by the current range table (see product description).

Monday to Friday are defined as working days.

II. Products

NightLinePlus, NightLine NextDay

1. General scope of services / scope

Nationwide transport of shipments with timely delivery to the recipient on the following working day (Monday to Friday) after acceptance of the shipment or according to the deadline ( NightLinePlus only). * Abroad on request.
NightLinePlus 8 - delivery by 8 a.m.
NightLinePlus 10 - delivery by 10 a.m.
NightLinePlus 12 - delivery by 12 noon
NightLine NextDay - delivery on the following working day (Monday to Friday) within normal business hours

2. General requirements

To provide the services offered, the following general requirements must be met:

  • Separate notification and labeling of the shipping order with reference to NightLinePlus 8, 10 or 12 or . NightLine NextDay
  • The readiness to accept the provision of services must be given from 7.30 a.m. If the recipient is not ready to accept delivery during normal business hours and by the agreed time at the latest, additional costs of 50 percent will be charged for the required second delivery (based on the current NightLine tariff).
  • The NextDay loading of living plants takes place from Monday to Thursday (Friday only by arrangement)

3. Dimensions and weights

  • Up to a maximum of 3,000 kg shipment weight and 3 loading meters, beyond this on request.
  • The following applies to shipping living plants with NightLine NextDay :
    • Maximum unit size per package 120 x 120 cm, the pallets must not be overpacked.
    • The packaging of the goods must be as follows:
      • boxes lined with foil or
      • air-permeable transport containers or
      • Cool boxes, polystyrene boxes or
      • Firmly wrapped in air-permeable film (e.g. for turf)
    • Flat-rate parking permit required for B2C recipients

4. Additional product specific exclusions

Advice consignments, island deliveries, cash on delivery, heavy goods (only NightLinePlus ), seaports, self-collection consignments, for living plants loading on a Friday (unless otherwise agreed), customs goods

5. Postage

Only free postage is permitted .

NightLineFix

1. General scope of services / scope

National delivery schedule to the day (delivery greater than 1 day) *, optionally with delivery by 8, 10 or 12 a.m.

2. General requirements

  • The acceptance of the goods must be at least 2 working days before the delivery date, otherwise the NightLine NextDay product will apply
  • From the fifth day onwards, storage fees apply

ServiceLine

1. General scope of services / scope - This service is currently suspended due to the corona pandemic.

Nationwide service free to the point of use , abroad on request

2. The following additional services can be booked with the ServiceLine product by prior arrangement and for a fee:

  • Unzip
  • Transport of packaging (untreated transport and outer packaging free of product residues) to a location to be determined by the client
  • Return for recycling
  • Return to the manufacturer
  • Return of exchange devices, provided there is a written order from the client (according to § 25 KrW- / AbfG, voluntary return)
  • Removal with 2 men

3. General requirements

To provide the services offered, the following general requirements must be met:

  • Prior notification and clarification of the delivery situation / the general conditions on site by the delivering company
  • The delivery must be able to be delivered with a suitable vehicle (clarification during the notification process) and the necessary equipment (drivability and unhindered access)
  • Clear identification of the desired additional services on the medium used for the transmission of the transport data, such as forwarding order, EDI or pick-up notification
  • Correct sender and recipient details on a clearly legible label on each shipping unit of a shipment
  • Provision of the shipments at the agreed pick-up time

4. Dimensions and weights

The following are permitted per collo (provided the local requirements are met at the time of delivery):

  • Side length: max. 240 cm
  • Height: max. 200 cm
  • Individual weight: up to max. 150 kg. The Collo must be able to be moved to the point of use with a pallet truck. Maximum weight limit for ablation without the possibility of using aids: 30 kg / man and collo.

5. Additional product-specific exclusions

Island delivery, customs goods, goods in accordance with Section 3.3 ADSp [goods in accordance with ADR of classes 1, 2, 4.1 (Numbers 21–26), 5.2 (Numbers 11–20) and 7 (Sheets 5–13) as well as waste for disposal and waste requiring special supervision for recycling in accordance with KrW- / AbfG (recycling and waste law) as well as goods in tanks and tank containers except in approved packages according to ADR], heavy goods

ThermoLine

1. General scope of services / scope

National quality assurance through comprehensive protection against frost from collection to delivery. ThermoLine can be combined with the following CargoLine products: NightLinePlus 10 (delivery by 10 a.m.), NightLinePlus 12 (delivery by 12 p.m.), ServiceLine delivery note .

2. General requirements

To provide the services offered, the following general requirements must be met:

  • Loading Monday to Thursday
  • One day advance notice from the customer
  • The sender must ensure that the goods are ready for loading in a frost-free condition (at least 15 ° C).

3. Dimensions and weights

  • Side length: max. 120 cm
  • Width: max. 120 cm
  • Height: max. 160 cm
  • Larger packages by arrangement
  • Scope of a shipment: up to 3 pallet spaces (more by arrangement)

4. Additional product specific exclusions

  • Island delivery, cash on delivery, 48-hour areas, seaports, consignment notification at the recipient, loading on a Friday, customs goods

B2CLine, B2CLine Plus and B2CLine Premium

1. General scope of services / scope

Nationwide notification of goods ordered online by SMS and / or email

The delivery takes place at specified time windows

  • free curbside ( B2CLine )
  • free point of use with a man ( B2CLine Plus ) - currently exposed due to corona
  • free point of use with two men ( B2CLine Premium ) - currently suspended due to corona

Evening delivery (between 5pm and 10pm, only B2CLine Plus and B2CLine Premium ), individual delivery dates and special services can be arranged under certain conditions (see "2. General Conditions")

A pallet exchange is only possible for standardized Euro flat pallets and only when booking the B2CLine Plus and B2CLine Premium products. There is no general obligation to exchange.

2. General requirements

  • Availability of the goods
  • Provision at the agreed pick-up time
  • Suitable packaging that is suitable for use and safe for transport
  • Correct sender information, addressing and marking on all packages
  • Properly completed shipping order
  • Normal transport conditions and unimpeded connections
  • Accessible packages
  • For a notification by e-mail and / or SMS, the e-mail address and / or mobile phone number of the recipient must be transmitted with the shipment data. Otherwise, notification will be made by telephone, provided a landline number is available
  • For delivery the day after the notification (24-hour service), the recipient must send an appointment confirmation by 10 p.m. on the notification day. Otherwise the next but one working day is offered
  • In order to book additional services and special services such as selecting a delivery window when placing an order, the notification platform must be integrated into the respective web shop

1. General description of services

Delivery of general cargo within 1 day directly to the recipient in defined countries and regions of Europe (see pdf NightLineEurope_NextDay ) - and to other destinations by arrangement *

2. General requirements

  • No delivery with a lifting platform, the recipient must be able to unload
  • The shipment must be palletized and accessible
  • Identification of the shipping order with reference to NightLineEurope NextDay
  • The willingness to accept the provision of services must be given during normal business hours and by the agreed time at the latest. If this is not the case, additional costs will be charged for the required second delivery (based on the current NightLineEurope NextDay tariff / surcharge)

Preferred transport of goods, thus safe delivery within the normal delivery time in around 30 European countries according to the individual delivery time overview in the country of destination and taking into account the defined arrival times and time window regulations from Germany to Europe as well as pan-European between the contractual partners. *

2. General requirements

  • The recipient must be able to unload.

3. Dimensions and weights

  • Height: max. 215 cm (France 180 cm)
  • Up to a maximum of 3,000 kg chargeable weight, beyond this on request

4. Additional product specific exclusions

  • Advice consignments, procurement orders, remote locations in alpine mountain regions (according to partner definition), cash on delivery, seaport deliveries, self-collection consignments, deliveries to islands without a bridge connection
  • Additional special travel regulations, which are initiated by the client from the entry depot, do not include distances of more than 100 km from the respective reception depot on the product side

NightLineEurope Fix

1. General scope of services / scope

Delivery of goods to around 30 European countries on a day specified at the time of commissioning in the near future according to the individual transit times overview in the country of destination and taking into account the defined arrival times and time window regulations from Germany to Europe and pan-European between the contractual partners. *

2. General requirements

  • Bookable for deliveries of goods whose delivery date is 1 to a maximum of 5 working days longer than the defined standard delivery time, otherwise the NightLineEurope Priority product applies.
  • If the defined fixed date exceeds the fifth day of the defined standard term, storage fees can be charged.

NightLineEurope Receipt

1. General scope of services / scope

In the defined European countries, NightLineEurope Receipt enables the customer to receive the delivery receipt on the separately delivered delivery note when their goods are delivered, both from Germany to Europe and pan-European between the contractual partners. *

2. General requirements

Delivery notes are to be sent to the receiving depot separately by e-mail (PDF) to the specified e-mail addresses by midnight on the day of loading at the latest.

3. Dimensions and weights

Up to a maximum of 3,000 kg chargeable weight, beyond this on request

4. Additional product specific exclusions

Procurement orders, island delivery, cash on delivery, seaport delivery. Deviating or supplementary exclusions due to the combination with other European products must be observed.

5. Postage

Only DAP and DDP are permitted.

* If delivery does not take place as promised, the customer only pays for the service actually provided. Exceptions: force majeure, not timely customs clearance.

SeaLine

1. General scope of services / scope

Starting from or to Hamburg, Bremen or Rotterdam, SeaLine enables general cargo shipments to be moved to other continents or procured from there as part of collective shipments (LCL). Invoicing takes place in Germany (import + export).
The following services are not included in SeaLine:

  • Transport insurance
  • Customs clearance (export / import) is the responsibility of the client. The latter can commission the responsible CargoLine partner to handle the customs services separately.
  • Export: Collect business only on request

2. General requirements

Seaworthy packaging / marking

  • The goods must be packed for seaworthiness and properly marked. Pay particular attention to special handling instructions according to ISO 55402 or ISO R / 780.
  • Liability in the event of damage is rejected for packages that are not marked accordingly.

Collection in Hamburg (import)

  • The customer receives an arrival notification from the respective sea freight forwarder approx. 10 days before ETA.
  • The customs formalities are to be checked by the importer before acceptance (including T1 and import customs clearance).
  • Acceptance at the port is only possible with a certificate of commitment (A18).

Delivery in Hamburg (export)

  • CargoLine premium products do not apply to port deliveries in Hamburg.
  • Delivery in port only with quay delivery note (A08)
  • The delivery reference of the booking confirmation must be observed.
  • The Z number is to be created.

Delivery in Bremen (export)

  • CargoLine premium products do not apply to port deliveries in Bremen.
  • Delivery in Bremen only with a complete delivery reference.
  • The delivery reference of the booking confirmation must be observed.

In order to enable smooth processing, it is recommended that the customer issues a Sea Waybill or a Telex Release of the bill of lading (Bill of Lading, B / L). This means that no original B / Ls would have to be presented in the receiving port.
